1. Agreement to Terms

Welcome to YourClaws ("Company," "we," "our," or "us"). These Terms of Service ("Terms") govern your use of our website, booking system, and nail salon services (collectively, the "Services").

By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use our Services.

These Terms comply with:

2. Service Description

YourClaws is a professional nail salon service located in Malang, Indonesia, operated by a business entity in the United States. We offer the following services:

  • Manicure Services: Professional nail care and grooming
  • Overlay Nails: Strengthening and protective nail treatments
  • Gel Nails: Long-lasting gel polish applications
  • Nail Art: Custom nail designs and artistic decorations

Our website provides an online booking system, service information, customer reviews, and contact features. We reserve the right to modify, suspend, or discontinue any aspect of our Services at any time without prior notice.

3. Eligibility

You must be at least 16 years old to use our Services independently. Users under 16 years of age must have parental or guardian consent to book appointments or use our Services.

By using our Services, you represent and warrant that:

  • You have the legal capacity to enter into these Terms
  • All information you provide is accurate, current, and complete
  • You will maintain the accuracy of such information
  • You will not use our Services for any illegal or unauthorized purpose

4. Booking and Appointments

4.1 Booking Process

To book an appointment, you must:

  • Provide accurate contact information (name, phone number, and optionally email)
  • Select your desired service and preferred date/time
  • Complete the hCaptcha verification to prevent spam
  • Await confirmation from our team via WhatsApp and/or email

4.2 Booking Confirmation

Bookings are not confirmed until you receive a confirmation message from us via WhatsApp (+62 882-9108-4467) or email ([email protected] or [email protected]). We review all booking requests and confirm appointments based on availability.

4.3 Pricing

Service prices are determined on a case-by-case basis and will be communicated to you during the booking confirmation process. Final pricing may vary based on:

  • Complexity of the requested design or service
  • Time required to complete the service
  • Materials and products used
  • Any special requests or modifications

4.4 Cancellations and Rescheduling

If you need to cancel or reschedule your appointment, please contact us as soon as possible via:

Cancellation Policy:

  • Cancellations made at least 24 hours before your appointment: No penalty
  • Cancellations made less than 24 hours before your appointment: May result in appointment restrictions
  • No-shows without prior notice: May result in being unable to book future appointments

4.5 Late Arrivals

If you arrive more than 15 minutes late to your appointment without prior notice, we reserve the right to cancel or reschedule your appointment. We strive to accommodate all clients, but late arrivals may impact subsequent appointments.

4.6 Business Hours and Availability

Our standard business hours and available appointment times are displayed on our website. We may set unavailable dates for holidays, closures, or special events. Please check the booking system for current availability.

5. Payment Terms

Payment for services is due at the time of service completion unless otherwise agreed upon. We accept the following payment methods:

  • Cash (Indonesian Rupiah)
  • Bank transfer (details provided upon request)
  • Other payment methods as communicated during booking confirmation

All prices are in Indonesian Rupiah (IDR) unless otherwise stated. You are responsible for any applicable taxes or fees associated with the payment.

6. Customer Responsibilities

As a customer, you agree to:

  • Arrive on time for your scheduled appointment
  • Provide accurate and complete information during booking
  • Inform us of any allergies, sensitivities, or health conditions that may affect the service
  • Follow aftercare instructions provided by our nail technician
  • Treat our staff and facilities with respect and courtesy
  • Notify us immediately if you experience any adverse reactions to our services
  • Not engage in disruptive, abusive, or inappropriate behavior

We reserve the right to refuse service or terminate an appointment if you violate these responsibilities or engage in inappropriate conduct.

7. Health and Safety

We prioritize the health and safety of our clients. All tools and equipment are sanitized and sterilized according to professional standards. However, you acknowledge that:

  • Nail services may carry inherent risks, including allergic reactions, infections, or injuries
  • You are responsible for informing us of any pre-existing medical conditions, allergies, or sensitivities
  • We are not liable for adverse reactions if you fail to disclose relevant health information
  • You should seek immediate medical attention if you experience severe reactions or complications

If you are pregnant, nursing, or have compromised immunity, we recommend consulting with a healthcare professional before receiving nail services.

8. Reviews and User Content

8.1 Review Submission

After your appointment, you may receive an invitation to submit a review. By submitting a review, you grant us a perpetual, worldwide, royalty-free license to use, display, reproduce, and distribute your review and any accompanying images (up to 5 images, max 10MB per image in JPEG, PNG, GIF, or WebP format) on our website and marketing materials.

8.2 Review Guidelines

When submitting a review, you agree to:

  • Provide honest and accurate feedback based on your actual experience
  • Not include offensive, defamatory, discriminatory, or inappropriate content
  • Not include personal information about staff members or other clients
  • Not upload images that violate copyright, privacy, or other legal rights
  • Ensure your review complies with all applicable laws and regulations

8.3 Review Moderation

We reserve the right to approve, reject, edit, or remove any review that violates these Terms or is deemed inappropriate. Published reviews may be displayed on our website for public viewing.

The use of these logos does not imply endorsement by WhatsApp, Instagram, or Meta. We use these marks solely to identify our official business accounts on these platforms and to provide convenient communication channels for our customers. All rights to these trademarks are reserved by their respective owners.

10. Prohibited Uses

You agree not to use our Services to:

  • Violate any applicable local, state, national, or international law or regulation
  • Transmit or upload viruses, malware, or other harmful code
  • Engage in unauthorized access, hacking, or security breaches
  • Impersonate any person or entity or misrepresent your affiliation
  • Harass, threaten, defame, or abuse our staff or other users

11. Disclaimer of Warranties

Our Services are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to:

  • Merchantability, fitness for a particular purpose, or non-infringement
  • Uninterrupted, secure, or error-free operation of our website
  • Accuracy, reliability, or completeness of information on our website
  • Specific results or outcomes from our nail services

We do not warrant that our Services will meet your expectations or that defects will be corrected. Your use of our Services is at your sole risk.

12. Limitation of Liability

To the fullest extent permitted by law, YourClaws, its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to:

  • Errors, mistakes, or inaccuracies in content or services
  • Personal injury, property damage, or allergic reactions resulting from services
  • Interruption or cessation of service transmission

Our total liability to you for any claims arising from these Terms or our Services shall not exceed the amount you paid for the specific service that gave rise to the claim, or IDR 500,000, whichever is greater.

Indonesian Consumer Rights: This limitation of liability does not affect your statutory consumer rights under Indonesian Law No. 8 of 1999 on Consumer Protection, which cannot be waived or limited by contract.

13. Indemnification

You agree to indemnify, defend, and hold harmless YourClaws, its owners, employees, contractors, and affiliates from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your violation of these Terms or applicable laws
  • Your use or misuse of our Services
  • Your violation of any third-party rights, including intellectual property or privacy rights
  • Any content or information you submit, including reviews and images
  • Your failure to disclose relevant health information that results in injury or adverse reactions

14. Privacy and Data Protection

For Indonesian residents: Any disputes arising out of or related to these Terms or our Services shall be subject to the exclusive jurisdiction of the courts of Malang, East Java, Indonesia, or the Indonesian Consumer Dispute Settlement Agency (BPSK - Badan Penyelesaian Sengketa Konsumen) as provided under Indonesian consumer protection law.

17. Modifications to Terms

We reserve the right to modify, amend, or update these Terms at any time. When we make material changes, we will:

  • Notify you via email or website notice (where reasonably practicable)

19. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

20. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and YourClaws regarding your use of our Services and supersede all prior or contemporaneous understandings, agreements, representations, and warranties.
